A&K Elite Auto Detailing – Comprehensive Terms and Conditions Agreement

1. Agreement to Terms

These Terms and Conditions (“Agreement”) govern your use of services offered by A&K Elite Auto Detailing (“Company,” “we,” “us,” or “our”). By scheduling, booking, purchasing, or receiving services from us, you (“Customer,” “you,” or “your”) agree to be legally bound by this Agreement.

If you do not agree with any part of this Agreement, you must not proceed with using our services.

2. Scope of Services

Exterior:

Deep Wheel Cleaning + Tire Shine & Protective Tire Sealant

Cleaning Power for Effortless Dirt Removal
Full Ceramic Spray Coating
for Enhanced Shine & Durability
Hand Wash for Car Mats & Engine Bay Cleaning

(Seats, Carpet, Trunk, Hard-to-Reach Areas)
Full Interior Detail (Dash, Door Panels, Cupholders, Vents, Crevices)

We reserve the right to update or change services at any time without prior notice.

3. Service Disclaimer and Assumption of Risk

You acknowledge and agree that:

All services carry inherent risks, including, but not limited to: minor scratches, swirl marks, fading paint, electronic malfunctions, or exposure-related reactions.
We do not guarantee the removal of all stains, odors, scratches, or imperfections.
Results may vary depending on the age, condition, and material of your vehicle.
Some surfaces or materials may be damaged by water, heat, chemicals, or the detailing process, and you voluntarily accept these risks.

You hereby release and forever discharge A&K Elite Auto Detailing from any liability for the above risks, even if caused by our negligence.

4. Waiver of Liability

To the fullest extent allowed by law, you waive and release A&K Elite Auto Detailing, its owners, employees, contractors, agents, affiliates, and successors from any and all claims, damages, or liabilities, including:

Property damage (including scratches, dents, damaged interiors or electronics)
Mechanical or electrical failures following the service
Personal injury (e.g., slips, trips, or exposure to chemicals)
Theft or loss of items inside the vehicle
Environmental factors (e.g., rain, heat, dust) affecting results
Allergic or medical reactions to scents or chemicals used

You agree not to sue or hold us responsible for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages.

5. Vehicle Condition Disclosure

Customers are required to:

Inform us of any pre-existing damage, modifications, or delicate areas.
Remove all valuables, cash, electronics, firearms, medications, and sensitive items prior to service.

We are not liable for damage caused by pre-existing conditions or items left in the vehicle.

6. Payment Policy

Payment Terms:

Full payment is due after the service, unless otherwise agreed in writing.
We accept credit/debit cards, PayPal, Venmo, Zelle, and cash (if allowed by local law).

Refund Policy:

Please discuss with our team.

In cases of incomplete service due to our fault, a partial refund or re-service may be offered at our sole discretion.

Chargebacks:

Initiating a fraudulent chargeback after service is a breach of this Agreement and may result in legal action.

Late Fees:

Late payments may be subject to a $25 late fee per week and potential collections.

7. Cancellation and Rescheduling Policy

Cancellations or reschedules require at least 24 hours’ notice.
No-shows or same-day cancellations may be charged $25 fee

8. Weather and Location Policy

We reserve the right to reschedule due to unsafe or unsuitable weather (e.g., rain, storms, excessive heat/cold).
Mobile detailing customers must provide a safe, legal, and accessible location with adequate space, lighting, and water/electric access if required.
We may refuse service on unsafe property or in restricted areas.

9. Photos, Videos, and Marketing Use

You authorize A&K Elite Auto Detailing to take photos and videos of your vehicle before, during, or after service for documentation and promotional purposes.
If you do not consent to promotional use, you must inform us in writing before the appointment.

10. Extra Charges and Contamination Fees

Additional charges may apply for excessive dirt, pet hair, mold, mildew, feces, vomit, blood, pests, or hazardous materials.
We reserve the right to refuse service for biohazards, infestations, or unsafe conditions.

11. Customer Conduct and Cooperation

Customers must not interfere with or harass detailing staff.
You must secure pets, children, and obstacles in the area of service.
Rude, disrespectful, or threatening behavior will result in service refusal without refund.

12. Limitation of Warranties

All services are provided “as-is” and “as-available.” We disclaim all warranties, express or implied, including but not limited to:

Fitness for a particular purpose
Merchantability
Service results or performance guarantees
Warranty of duration or effect of detailing products (e.g., waxes, coatings)

13. Legal Capacity and Age of Workers

By receiving service, you acknowledge:

Our employees and contractors are at least 14 years old, trained, and permitted to perform the service safely.
The legal guardian of any underage worker accepts full responsibility and oversight.

14. Dispute Resolution and Binding Arbitration

Initial Resolution:

You agree to first attempt to resolve any dispute by contacting us in writing.

Binding Arbitration:

All disputes that cannot be resolved informally will be settled by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).
Arbitration will occur in Wisconsin, and the arbitrator’s decision is final.

You waive your right to a jury trial or participation in a class action lawsuit.

15. Force Majeure

We are not liable for delays or failures due to circumstances beyond our control, including:

Natural disasters
Power outages
Pandemics or public health emergencies
Government actions
Internet or communication failures

16. Privacy Policy

We collect and store your data only for:

Scheduling and fulfilling services
Customer communication
Payment processing
Legal compliance

We do not sell or rent your data to third parties.

17. Intellectual Property

All logos, branding, images, videos, and written materials on our website or marketing materials are owned by A&K Elite Auto Detailing. You may not copy, share, or use our intellectual property without written permission.

18. Severability

If any part of this Agreement is found to be invalid or unenforceable, the rest shall remain fully in effect.

19. Entire Agreement

This Agreement represents the entire understanding between you and A&K Elite Auto Detailing. It supersedes any prior communications, promises, or agreements.

20. Modifications to Terms

We reserve the right to change these Terms at any time. Updates will be posted to our website, and your continued use of our services signifies your acceptance of changes.

21. Acknowledgment

By booking or receiving service, you confirm that:

You have read and understood this entire Agreement.
You are at least 18 years old or have legal guardian consent.
You accept all risks and waive your right to pursue legal action against A&K Elite Auto Detailing under the terms described above.
